Paul Underkofler and Cara Kennemer participated in a two-day seminar sponsored by the Construction Law Section of the State Bar of Texas on November 17 and 18, 2011. As the luncheon speaker at the Basic Course in Construction, Cara addressed the topic, “Tips on Avoiding Malpractice for the Young Construction Lawyer”. Paul spoke on the subject of “What Works and What doesn’t Work in Construction Mediations”. Insight as to both presentations are available upon request.
In October 2011, David Paschall and long-time GUC&L clients prevailed in an AAA arbitration where the claimant sought significant damages. Working closely with our clients, David developed a strong defense to the adverse claims and support for a counter-claim. After three days of lengthy arbitration hearings, an Award in favor of GUC&L’s clients on their counterclaim and dismissal of the adverse claims was obtained. The Award included an award of attorneys’ fees and costs of arbitration in favor of our clients.
During the 2011 spring election season, James Morris and David Paschall successfully defended a local municipality and its secretary against a petition filed by a group of local candidates to remove competing candidates from the ballot based on allegations of non-compliance with Texas Election Code requirements. Filed as an original proceeding before the 5th District Court of Appeals of Texas at Dallas, Jim and David quickly obtained a denial of the petition which allowed the election to proceed as scheduled and with all candidates on the ballot.
